ASF INK IT by law retains all rights to materials and content on its websites. Our websites, all of the software and codes used, the text, images, video and audio-video, photographs, illustrations and graphics, sound recordings and other materials and user-generated content, fall under the protection of applicable intellectual property and other proprietary laws, including without limitation to those of the United States. All the content and intellectual property rights are the sole ownership of ASF INK IT, and are protected pursuant to all applicable trademark and copyright laws.

The content displayed on our website does not constitute a waiver of right to anyone for that content.

Age Restriction

ASF INK IT does not knowingly do business with customers under 18 years old. We require that our customers be over 18 years of age to purchase products on any of our ASF INK IT websites. If you are under 18 years old, you must have authority from either a parent or guardian to purchase products from any of our websites.

Your Obligation and Responsibility

You agree to use all of our website in a manner consistent with any and all rules and regulations that apply. You also agree not to transmit or upload to our websites any computer viruses, worms, trojan horses or anything that may interfere, disrupt or interrupt the normal operations of a computer.

User-Generated Content

We cannot be held liable for any user-generated content made available on our websites by us or others.

Unacceptable Artwork Submissions

ASF INK IT has the sole discretion to reject any orders or submissions that contain text or design that could be considered libelous, profane, obscene or defamatory (as established by the Federal Communications Commission), displays or portrays irresponsible use of alcohol and/or other substances, promotes persecution based on race, age, gender, disability or national origin, or contains explicit sexual content or is in any way inappropriate.

Removal of Content

We will review requests to remove content from our websites that you believe violates your rights.

Product Consistency

ASF INK IT cannot guarantee that all products purchased will be 100 percent consistent in color and material. Minor variations in dye lots, material thickness and finish may occur in the manufacturing process.

California Proposition 65

ASF INK IT makes every effort to remain compliant with California Proposition 65 for the safety of our customers.

ASF INK IT strives for complete compliance pursuant to California’s Safe Drinking Water & Toxic Enforcement Act, also known as “Proposition 65” or “Prop 65.”

Enacted in 1986 and updated in August 2016, Prop 65 seeks to protect California residents from exposures to chemicals classified as carcinogens or reproductive toxicants. The State of California has comprised a list of more than 850 chemicals known to cause cancer, reproductive harm or birth defects.

A large number of chemicals on the list are given safe harbor levels by the Office of Environmental Health Hazard Assessment (OEHHA), which are used to determine overall exposure risks. These levels include No Significant Risk Levels (NSRLs) for cancer causing chemicals, and Maximum Allowable Dose Levels (MADLs) for chemical reproductive toxicity.

If a product contains a chemical composition that surpasses safe harbor levels or if no safe harbor level exists, a warning label is affixed to the product alerting Californian consumers of potential risks. Persons are in violation of Prop 65 for failing to provide adequate warnings. ASF INK IT complies with this requirement by: 1.) providing a Prop 65 warning, within the product description, on our ASF INK IT website and 2.) providing labels on all necessary items shipped to California. ASF INK IT manufactures high-quality, safe products that meet all applicable federal safety and warning requirements, regulations and standards as enforced by the Consumer Product Safety Commission, the Federal Communications Commission and the U.S. Food and Drug Administration.

CPSIA

Our products are meant for promotional use only. ASF INK IT is a promotional products company. Very few items on our website are intended to be used by children. These items are identified by using the term “Youth” in the product name. Otherwise, we do not directly market to children or target children under the age of 13. All other items are intended for advertising and promotional purposes ONLY.

Changes on Our Site/Correction of Inaccuracies

We retain the right to make corrections, revoke offers, make adjustments or take other action based on errors made by us.

Liability for Links

We are not responsible for links to other websites that may appear on our website.

Orders, Shipping & Returns

Conditional Acceptance

When you place an order with ASF INK IT, you have conditionally agreed to our Terms and Conditions. Your submission of an online order or telephone order to ASF INK IT is considered a conditional acceptance of your consent to purchase merchandise from us, and confirms your acceptance of our terms and conditions of sale as set forth.

Access and use of our websites and all information, products, services and materials available is subject to all applicable laws and regulations, including our stated Terms and Conditions.

Cancellation or Changes to Existing Orders

You may be subject to charges or service fees if you cancel or make changes to your order. Once an order has been submitted to production, ASF INK IT cannot guarantee that you will have the option to make changes or the ability to cancel your order. Applicable fees will be assessed to process any changes or a cancellation made at this point. Charge amounts depend on the extent of work already completed. We will advise you in writing of any and all costs incurred prior to making changes or cancellations with us. You will be responsible for payment of those charges without dispute.

Please note: Orders are extremely difficult to change or cancel after you have approved your order.

Product Return Policy

ASF INK IT is dedicated to providing high-quality, customized products for you and your event. Although we strive for perfection, we understand that mistakes happen! If we make a mistake, we will review the issue and do our very best to remedy the situation.

If you have problems with your order, please contact your Graphic Account Manager to fill out and submit a Ticket. The completed form will be sent to our Warranty Department and an agent will contact you within two business days, during department hours, Monday-Friday.

If your request is approved, a Return Authorization will be sent to you via email with instructions to return ship your product(s). Please do not return merchandise to us without a Return Authorization. No refunds will be issued for returned merchandise without our prior authorization.

However, due to the customized nature of our products, ASF INK IT cannot accept returns for printed items that pass our production quality standards. ***Once shipped, orders meeting ASF INK IT’s satisfactory standard are NON RETURNABLE***. There may be an opportunity to make changes to the order while still in production, however, applicable fees will be assessed. Once the order has begun printing it cannot be cancelled. Please see Cancellation or Changes to Existing Orders for more details.

We cannot accept any returned merchandise after 40 days from the date the invoice was created.

Packages that have been returned to sender will be held for 30 calendar days. Reshipment fees will be assessed for delivery.

Claims for merchandise damaged in transit must be handled by the shipping carrier. ASF INK IT is held free and harmless from damages of this kind.

We want you to be satisfied with your order and enjoy your shopping experience. Feel free to contact our customer service department, at any time, for clarification of these terms.

Delivery Dates

ASF INK IT will review then approve, disprove or may change your production or delivery times to meet your Guaranteed Delivery Date. An email will be sent letting the customer know if the requested delivery date can be met. The order must be finalized by the cutoff time (Noon Central Standard Time.) Fees for rush services will be refunded if an order misses the Guaranteed Delivery Date. However, Guaranteed Delivery Dates will not be valid when using a PO Box. A street address will be required. All merchandise remains subject to the Product Return Policy.

Delivery Delays and Transfer of Ownership Merchandise

We are not liable for specific product delays, damages or other claims after our products leave our production facility. ASK INK IT will not be held liable for any specific damages or consequential claims that exceed the invoiced value of the merchandise purchased if the merchandise is not delivered on a specified date or is delayed in transit based on circumstances beyond our control. Delivery dates are “estimates” made in conjunction with freight carriers. “Guaranteed” dates are also considered estimates and should not be mistaken for an absolute in hands date. Although, we promise to meet production deadlines, ASF INK IT is not responsible for delays due to our shipping carriers. Our products are sold Freight on Board (FOB) and are owned by the purchaser once they are picked up by the shipping company.

Returned Checks

We will charge a $50.00 fee for any checks we receive for insufficient funds.

Legal Terms

Warranties

We warrant that all merchandise sold to you by ASF INK IT is free of any security interest. We do not express or imply any warranties as to the fitness for purpose of the merchandise you purchase from us.

Liability Policy

ASF INK IT offers a limited liability policy with exclusions to protect our customers and ourselves.

ASF INK IT, its owners, affiliates, agents, and any other related parties shall not be liable to another party for any indirect, incidental or consequential damages (including without limitation, damages resulting from loss of use, loss of profits, interruption or loss of business, (lost goodwill, lost revenue and lost opportunity) arising out of the use of this website or with respect to the products and services offered for purchase hereunder. The foregoing limitation of liability and exclusion of damages applies even if a party had or should have had knowledge, actual or constructive, of the possibility of such damage. The foregoing limitation of liability and exclusion of damages shall apply whether a claim is based on breach of contract, breach of warranty, tort (including negligence), product liability, strict liability or otherwise, and notwithstanding any failure of essential purpose of any limited remedy herein. ASF INKI IT’S maximum liability for products is limited to the purchase price of the products sold. We will not under any circumstance be held liable for any claim or action that exceeds this liability limit. We also will not be liable for any third-party claims for damages against the customer, or for malfunction of product, cause of delays, interruption of service, or loss of business.

ASF INK IT makes no representation or warranties, express or implied, regarding the quality, safety, or performance of any product sold on the website. This includes, but is not limited to, implied warranties of merchantability and fitness for a particular purpose.

It is the responsibility of the customer to verify the suitability, compatibility, and proper use of products purchased. ASF INK IT is not liable for any misuse, abuse, or improper handling of a product.

The use of automated systems, including but not limited to bots, spiders, and other artificial intelligence (AI) tools, for the purpose of scraping or extracting data from this website is strictly prohibited. Unauthorized scraping poses a threat to the security, privacy, and integrity of the information available on this website, and any attempt to scrape the website may result in legal action. We actively monitor and employ measures to detect and prevent scraping activities on our website. Engaging in scraping activities may lead to legal consequences, including but not limited to legal action, damages and injunctive relief.

Disputes

All unsettled disputes or claims between you and ASF INK IT will be resolved through binding individual arbitration.

Jurisdiction: ASF INK IT is based in San Antonio, Texas, in Bexar County, so any legal action against us, related to our products or services, except when arbitration is required, must be filed/handled and/or take place in Bexar County, Texas.

If you experience problems related to our products or services, please contact ASF INK IT so we may help resolve the matter to your satisfaction. Per our Terms and Conditions, you agree that any unsettled dispute or claim you may have with ASF INK IT shall be decided by binding individual arbitration, not in court (unless your claim qualifies for small claims court). This agreement means that you waive your right to file a claim in court, or participate in class arbitrations, class actions or representative actions.

Force Majeure

We cannot be held liable or in breach of contract via force majeure, an event or effect that cannot be reasonably anticipated or controlled, such as an act of God. Results of force majeure may include production or delivery delays.

Severability and Non-Waiver

Our Terms and Conditions and other policies remain valid even if individual provisions become invalid or are not enforced.
